SUBJECT MATTER OF THE CASE

The application concerns the right to vote of the applicant ’ s daughter. Upon the request of her parents, she was placed under partial guardianship owing to her intellectual disability. The competent court of first instance further decided her disenfranchisement on the basis of her lack of knowledge of basic aspects of the political and electoral systems and being easily influenced or impressionable.

QUESTION tO THE PARTIES

Has there been a breach of the applicant ’ s daughter ’ s (represented by her mother) right under Article 3 of Protocol No. 1 to vote in free elections which ensure the free expression of the opinion of the people in the choice of the legislature, read alone or in conjunction with Article 14 of the Convention and Article 1 of Protocol No. 12?
