Application no. 2893/17 Petar ŠARIĆ against Croatia lodged on 23 December 2016

SUBJECT MATTER OF THE CASE

The application concerns Article 6 §§ 1 and 3(b) of the Convention in relation to the criminal proceedings against the applicant on charges of the abuse of power in which the prosecution amended some factual aspects of the charges at a final hearing before the trial court and where the applicant ’ s request to be given a short deadline for preparing his defence in relation to such altered charges was dismissed.

QUESTIONS tO THE PARTIES

Were the criminal proceedings against the applicant, taken as a whole, fair as required under Article 6 § 1 of the Convention? In particular, was the applicant afforded adequate time to prepare his defence, as required by Article 6 § 3 (b) of the Convention?
