Application no. 61709/13 Marcel SAVANIU against Romania lodged on 26 September 2013

SUBJECT MATTER OF THE CASE

The application concerns the interdiction on leaving country imposed on the applicant by decision no. 321/R adopted by the Pite ÅŸ ti Court of Appeal on 8 May 2009. The applicant was under criminal investigations for alleged acts of corruption at that time. The interdiction remained in place until 4 February 2015 when the Ploie ÅŸ ti Court of Appeal adopted the final decision in the case, acquitting the applicant.

The applicant relies on Article 6 §§ 1 and 2 and Article 17 of the Convention, and on Article 2 of Protocol No. 4 to the Convention.

QUESTION tO THE PARTIES

Has there been a violation of the applicant ’ s freedom to leave the territory of the respondent State, contrary to Article 2 of Protocol No. 4, in so far as the measure adopted by the Piteşti Court of Appeal on 8 May 2009 is concerned?
