THIRD SECTION

Application no. 3138/16 Khalid AZERKANE against the Netherlands lodged on 8 January 2016

SUBJECT MATTER OF THE CASE

The application concerns the decision, taken in 2013 but with retroactive effect from 2011, and upheld by the national courts, to withdraw the applicant ’ s residence permit and to impose a ten-year entry ban on him after he had been convicted of a number of criminal offences. The applicant, who is a Moroccan national, was born in the Netherlands in 1993 and, apart from a four-week period in 2005, had lawful residence in that country until the impugned decision. He was living with his parents until, on 3 January 2018, he was placed in immigration detention with a view to his expulsion.

QUESTION tO THE PARTIES

Has there been a violation of the applicant ’ s right to respect for his private and family life contrary to Article 8 of the Convention?
