FOURTH SECTION

Application no. 17278/18 Anna Olegivna SOLOPOVA against Ukraine lodged on 12 April 2018

SUBJECT MATTER OF THE CASE

The application concerns alleged lack of medical assistance and treatment of a detainee ’ s oncology disease. The applicant has been held in the Dnipro pre-trial detention centre (the SIZO) since July 2017. She was diagnosed , among other conditions, with HIV (clinical stage IV AIDS), tuberculosis, and Hodgkin lymphoma. The applicant was prescribed a chemotherapy treatment consisting of four drugs components. As it appears from the case file documents, she has received only one drug component.

On 27 April 2018, the Court applied an interim measure in accordance with Rule 39 of the Rules of Court, indicating to the respondent Government “to immediately provide the applicant with the medical treatment in accordance with the established diagnosis and in compliance with the prescribed regimen of treatment, including the list of applicable drugs, their doses and schedule of treatment”. According to the information provided by the parties, the applicant had been transferred to the oncology hospital and received certain treatments which, however, were not provided in full due to lack of budget funds.

Referring to Article 3 of the Convention the applicant complains that she was not given access to appropriate medical assistance for her oncology disease while detained.

QUESTION tO THE PARTIES

Was the medical assistance and treatment provided to the applicant while in detention in compliance with the requirements of Article 3 of the Convention?
