SUBJECT MATTER OF THE CASE S

The applications concern the freezing of the applicants ’ bank accounts by the domestic authorities within the framework of criminal proceedings concerning the alleged unlawful activities of a number of non-governmental organisations.

QUESTIONS tO THE PARTIES

1. Has there been an interference with the applicants ’ peaceful enjoyment of possessions, within the meaning of Article 1 of Protocol No. 1 to the Convention, on account of the freezing of their bank accounts? If so, was that interference lawful and necessary to control the use of property in accordance with the general interest? In particular, did that interference impose an excessive individual burden on the applicants (see Immobiliare Saffi v. Italy [GC], no. 22774/93, § 59, ECHR 1999-V)?

2. Did the applicants have a fair hearing in the determination of their civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, were the applicants able to be present at the hearing before the domestic courts which ordered the freezing of their bank accounts? If not, were those proceedings compatible with the requirements of Article 6 of the Convention?

3. Has there been an interference with the applicants ’ freedom of association, within the meaning of Article 11 § 1 of the Convention, on account of the freezing of their bank accounts? If so, was that interference prescribed by law and necessary in terms of Article 11 § 2?

4. Were the restrictions imposed by the State in the present cases, purportedly pursuant to Article 11 of the Convention and Article 1 of Protocol No. 1 to the Convention, applied for a purpose other than those envisaged by those provisions, contrary to Article 18 of the Convention?
