SUBJECT MATTER OF THE CASE
The application concerns the applicant ’ s life sentence with possibility of release on parole after 40 years ’ time served.
In 2010 the applicant was sentenced to actual life imprisonment without the possibility of parole.
In László Magyar v. Hungary ( no. 73593/10, 20 May 2014) the Court held that the irreducibility of that sentence amounted to a violation of Article 3 of the Convention.
In review proceedings undertaken in pursuit of the Court ’ s judgment, on 11 June 2015 the Kúria changed the sentence and added the possibility of parole after 40 years.
QUESTION tO THE PARTIES
Has the applicant been deprived of any real prospect of release and thus subjected to inhuman punishment, in breach of Article 3 of the Convention, in view of the fact that he will not be eligible for release on parole before 40 years (see Vinter and Others v. the United Kingdom [GC], nos. 66069/09, 130/10 and 3896/10, ECHR 2013 (extracts); compare and contrast T.P. and A.T. v.
