SUBJECT MATTER OF THE CASE

The application concerns the search of the applicant ’ s flat in the course of a criminal investigation against her son-in-law. The applicant claims that the search was unlawful and that the domestic authorities during the search unlawfully seised a considerable amount of money belonging to her.

QUESTIONS tO THE PARTIES

1. Has there been an interference with the applicant ’ s right to respect for her home, within the meaning of Article 8 § 1 of the Convention? If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2?

2. Has the applicant been deprived of her possessions in the public interest, and in accordance with the conditions provided for by law, within the meaning of Article 1 of Protocol No. 1? If so, was that deprivation necessary to control the use of property in accordance with the general interest?
