SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s removal to Iraq. On 2 November 2016 the Finnish Immigration Service rejected the applicant ’ s asylum application and ordered his removal back to Iraq. The Service accepted the applicant ’ s account of events, including the facts that he had been pressured to change his religion into Shia and to join the Shia militia, and that he had been kidnapped. There was thus no credibility issue involved but, according to the Service, there was no reason to believe that the persecution would continue in the future since the applicant no longer worked as a high-ranking civil servant. On 6 March 2018 the Administrative Court rejected the applicant ’ s appeal on the same grounds as the Immigration Service. The applicant appealed to the Supreme Administrative Court where the case is still pending.

On 12 June 2018 the Court applied Rule 39 in the case.

The applicant complains under Articles 2 and 3 of the Convention that his removal to Iraq would put him at a real risk of ill-treatment and/or loss of life upon return.

QUESTION tO THE PARTIES

In the light of the applicant ’ s claims and the documents which have been submitted, would he face a risk of being subjected to treatment in breach of Article 3 of the Convention and/or loss of life under Article 2 of the Convention if the expulsion order were enforced?
