FIFTH SECTION

Application no. 54588/13 Shamil Nabi oglu GULIYEV against Azerbaijan lodged on 19 August 2013

SUBJECT MATTER OF THE CASE

The applicant, a former prosecutor, was dismissed from his job following several publications by his former partner in the newspaper about their conjugal life issues.

The applicant ’ s civil action against the newspaper and his partner was successful, but the courts dismissed his claims for pecuniary and non ‑ pecuniary damages.

The applicant also brought proceedings against his employer and asked for reinstatement in his position. By a final decision of 6 June 2013 the Supreme Court dismissed his claim.

QUESTIONS tO THE PARTIES

1. Did the applicant have a fair hearing in the determination of his civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, was the applicant ’ s right to a reasoned decision respected?

2. Has there been an interference with the applicant ’ s right to respect for his private life, within the meaning of Article 8 § 1 of the Convention, as a result of his dismissal from the prosecuting authorities because of his conjugal life problems? If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2?
