SUBJECT MATTER OF THE CASE

The application concerns the length of the applicant ’ s pre-trial detention (Article 5 § 3 of the Convention). The applicant was held in custody from 24 September 2008 to 21 May 2010 - 1 year, 7 months and 26 days - and from 29 March 2012 to 12 March 2013 - 11 months and 13 days. Between 21 May 2010 and 29 March 2012 the applicant was detained on the basis of his conviction by a decision of 21 May 2010 of the Tzentralno-Miskyy Local Court of Gorlivka which sentenced him to five years ’ imprisonment.

QUESTION tO THE PARTIES

Was the length of the applicant ’ s pre-trial detention in breach of the “reasonable time” requirement of Article 5 § 3 of the Convention?
