Application no. 39107/14 Natalia ROMANENCO against the Republic of Moldova lodged on 12 May 2014

SUBJECT MATTER OF THE CASE

The applicant lived and had an official registration in an apartment which belonged to her parents. Following civil proceedings between the applicant ’ s parents and a bank, the latter obtained a final judgment giving it property title over the apartment and ordering the parents ’ eviction from it. Since the applicant was not involved in the proceedings and the judgment did not order her eviction, the applicant refused to quit the apartment. Nevertheless the State enforcement authorities evicted her by force.

The applicant complains under Article 8 and 1 of Protocol No. 1 to the Convention that her eviction in the absence of a legal basis constituted a breach of her right to respect for her home and for her possessions. She also complains under Article 6 of the Convention that the proceedings were not fair because she was not involved in them.
