Application no. 76393/17 Gheorghe BOJANI against Romania lodged on 20 October 2017

SUBJECT MATTER OF THE CASE

The application concerns the alleged ill-treatment suffered by the applicant at the hands of police on 19 February 2014 and the domestic authorities ’ failure to conduct a prompt and effective investigation into his complaints.

On 15 December 2016, the prosecutor ’ s office decided to discontinue the proceedings. This decision was confirmed by a final judgment adopted on 18 July 2017 by the Salonta County Court.

QUESTIONS tO THE PARTIES

1. Was the applicant subjected to ill-treatment, in breach of Article 3 of the Convention, as a result of the acts allegedly perpetrated on him by four police officers on 19 February 2014 at the police station in Inand ?

2. Did the authorities conduct an effective investigation between 2014 and 2017 into the applicant ’ s allegations under Article 3? In particular, did the criminal investigation conducted by the domestic authorities fulfil the conditions of adequacy and promptness as required under the procedural head of Article 3 of the Convention ?
