Application no. 13326/18 Ana-Bianca PRVU against Romania lodged on 7 March 2018

SUBJECT MATTER OF THE CASE

The applicant complains that her husband, was killed by police officers on 26 September 2009 in breach of Article 2 of the Convention and that the national authorities failed to carry out an effective investigation into the killing.

The criminal investigation is still pending.

QUESTIONS tO THE PARTIES

1. Has the applicant ’ s late husband ’ s right to life, ensured by Article 2 of the Convention, been violated in the present case (see Gheorghe Cobzaru v. Romania , no. 6978/08, 25 June 2013 )?

In particular, did the applicant ’ s late husband ’ s death result from a use of force which was absolutely necessary for the purposes of paragraph 2 of this Article?

2. In this connection, has an effective investigation been conducted by the national authorities in order to establish whether the use of force had been absolutely necessary and proportional (see Nachova and Others v. Bulgaria [GC], nos. 43577/98 and 43579/98, ECHR 2005 ‑ VII)?
