Application no. 33515/16 T.M. and S.Y.M. against the Netherlands lodged on 8 June 2016

SUBJECT MATTER OF THE CASE

The application concerns the refusal to grant asylum to the applicants, a couple from Pakistan of whom the man has been a Christian since birth and the woman claims to be a convert from Islam to Christianity. The Netherlands authorities did not believe that the applicants were married in Pakistan by a Christian priest after the woman had converted to the man’s Christian faith. They complain that their removal to Pakistan would expose them to a real and personal risk of being subjected to treatment prohibited under Article 3 of the Convention.

QUESTION tO THE PARTIES

In the light of the applicants’ claims, the documents which have been submitted and the currently available information about the general security situation for Christians and converts from Islam to Christianity in Pakistan, would the applicants face a real and personal risk of being subjected to treatment in breach of Article 3 of the Convention if they were removed to Pakistan?
