Application no. 5113/15 POLITIC AL PARTY “ PATRIA ” against the Republic of Moldova and 17 other applications (see list appended)

SUBJECT MATTER OF THE CASE S

The first applicant is a political party which was running in the 2014 general elections. The other applicants are candidates on the electoral list of that party in the same elections. The application concerns the removal of the applicant party from the list of participants three days before the elections. The reason for removing the party was an unproven accusation that, contrary to the provisions of the electoral law, it had used money from abroad.

The applicants complain that the removal of the political party “Patria” from the list of candidates in the general elections was arbitrary and amounted to a breach of Article 3 of Protocol No. 1 to the Convention. The first applicant also claimed that its removal was in breach of Article 14 taken in conjunction with Article 3 of Protocol No. 1 to the Convention.

QUESTION tO THE PARTIES

Has there been a breach of the applicants ’ right under Article 3 of Protocol No. 1 to participate in free elections which have ensured the free expression of the opinion of the people in the choice of the legislature ( Orujov v. Azerbaijan , no. 4508/06, §§ 40-42, 26 July 2011; Khanhuseyn Aliyev v. Azerbaijan , no. 19554/06, 21 February 2012)?

The Government are requested to submit a full copy of the case-file in the domestic proceedings.
