Application no. 54129/16 Andrei MIRON against Romania lodged on 2 September 2016

SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s complaints about the material conditions of his detention, namely that he had contracted hepatitis C while being detained due to poor hygiene conditions. The case also refers to the applicant ’ s allegations that while in prison, he was deprived of adequate dental care, which has determined an almost complete tooth loss.

QUESTIONS TO THE PARTIES

1. Has the applicant exhausted the available domestic remedies in respect of his complaints under Article 3 of the Convention, taking into consideration the Court ’ s relevant case-law on the matter (see Fűlöp v. Romania , no. 18999/04 , § 31, 24 July 2012)?

2. In the affirmative, has there been a violation of Article 3 of the Convention on account of the applicant ’ s infection with hepatitis C while in prison, allegedly due to the inadequate conditions of detention therein, and/or on account of the lack of adequate dental treatment while in prison (see, mutatis mutandis , Fűlöp , cited above, § § 37-48, and V.D. v. Romania , no. 7078/02, §§ 82-99, 16 February 2010)?
