SUBJECT MATTER OF THE CASE

The application concerns disclosure of sensitive personal medical information about the applicant to an unauthorised State agent, who in turn forwarded it to a private person. It raises an issue under Article 8 of the Convention.

QUESTION tO THE PARTIES

Has there been a violation of Article 8 of the Convention in the present case owing to the disclosure of sensitive personal medical information about the applicant to an unauthorised State agent, and its forwarding to a private person? Can the applicant still claim to be a victim of such a violation in spite of the judgment in his favour and the sum awarded to him (see Z. v. Finland , no. 22009/93, §§ 60-114, 25 February 1997 )?
