SUBJECT MATTER OF THE CASE

The application is lodged by an Afghan woman from Kabul, who was born in 1987. After studying in the Netherlands for a few months, in 2017 she claimed asylum in that country. The Dutch authorities refused asylum. They believed that the applicant had worked for a German non ‑ governmental organisation (NGO) in Afghanistan, but they disbelieved that she had been threatened by the Taliban. The applicant complains under Article 3 that if expelled to Kabul she will be at risk of ill ‑ treatment because she is a westernised woman who used to work for a foreign NGO.

QUESTION TO THE PARTIES

1. In the light of the claims and documents submitted by the applicant, are there substantial grounds for believing that the applicant will face a real risk of treatment prohibited by Article 3 of the Convention if expelled to Afghanistan?

2. Was the applicant ’ s request for asylum examined in conformity with the procedural obligations stemming from Article 3 of the Convention?
