Application no. 56803/18 Marsel MUNIR JOHANA against Denmark lodged on 28 November 2018

SUBJECT MATTER OF THE CASE

The applicant is an Iraqi national, born in 1994, who entered Denmark when he was 4 years old. He has a criminal past. Twice he was imposed a conditional expulsion. By a final Supreme Court judgment of 19 September 2018, the applicant was convicted of assault under aggravating circumstances. He was sentenced to 6 months ’ imprisonment and an order for expulsion with a ban on re-entry for 6 years was imposed on him.

The applicant complained that the order expelling him from Denmark was in breach of Article 8 of the Convention.

QUESTION TO THE PARTIES

Was the Supreme Court ’ s decision of 19 September 2018 to expel the applicant from Denmark in breach of Article 8 of the Convention?
