Application no. 20274/16 Maria PROKOPIOU against Cyprus lodged on 4 April 2016

SUBJECT MATTER OF THE CASE

In the present application the applicant complains under Article 6 § 1 of the Convention about the length of the proceedings in appeal no. 364/2010 before the Supreme Court which lasted just under five years and which was brought under Law no. 2(I)/2010, the Law Providing For Effective Remedies for Exceeding the Reasonable Time Requirement for the Determination of Civil Rights and Obligations. In these proceedings she claimed a violation of her right to determination of her civil rights or obligations within a reasonable time by the Nicosia District Court in an action she had brought seeking damages for negligence (action no. 3424/2006).

QUESTION TO THE PARTIES

Was the length of the civil proceedings in appeal no. 364/2010, brought under Law no. 2(I)/2010, in breach of the “reasonable time” requirement of Article 6 § 1 of the Convention?

The Government are requested to provide the Court with the record of the proceedings.
