SUBJECT MATTER OF THE CASE
The application concerns the applicant ’ s right of access to a court. The applicant complains under Article 6 § 1 of the Convention that the Constitutional Court quashed the appellate court ’ s judgment, which was favourable to him, upon the constitutional complaint lodged by the other party to the proceedings for protection of personality rights, without informing him and giving him a chance to participate in the constitutional proceedings. The applicant complains, furthermore, that in such situation and without taking any evidence the Constitutional Court assessed the facts of the case and reached conclusions about the balance to be struck between his personality rights and the defendant ’ s freedom of expression, which are binding for the appellate court to which the case had been remitted.
QUESTION TO THE PARTIES
Having regard to the fact that the applicant could not take part in the proceedings before the Constitutional Court, and to the effect of the outcome of those proceedings on the applicant ’ s civil rights and obligations, was the applicant ’ s right of access to a court respected (see e.g. López Guió v. Slovakia , no. 10280/12, 3 June 2014)?
