THIRD SECTION
Application no. 71460/11 Khadzhimurad Labazanovich GUSENOV against Russia lodged on 1 November 2011
SUBJECT MATTER OF THE CASE
The application concerns interception of the applicant ’ s telephone communications in the framework of a criminal investigation against him and his detention pending trial.
QUESTIONS TO THE PARTIES
1. Did the length of the appeal proceedings against the detention order of 29 August 2010 comply with the “speed” requirement of Article 5 § 4 of the Convention?
2. Has the applicant complied with the six-month time-limit laid down in Article 35 § 1 of the Convention in respect of his complaint under Article 8 of the Convention? In particular, was the supervisory-review complaint against the interception authorisation an effective remedy to be taken into account for the calculation of the six-month time-limit?
3. Did the interception of the applicant ’ s telephone conversations violate his right to respect for his private life and correspondence (see Moskalev v. Russia , no. 44045/05 , 7 November 2017)?
4. Did the applicant have at his disposal an effective domestic remedy for his complaint under Article 8, as required by Article 13 of the Convention (see Konstantin Moskalev v. Russia , no. 59589/10 , 7 November 2017)?
