Application no. 24635/14 Valeriy Anatoliyovych YEVDOKIMOV against Ukraine lodged on 20 March 2014

SUBJECT MATTER OF THE CASE

The applicant is a former police officer who was convicted of bribery. The application concerns his following complaints, under Article 6 §§ 1, 3 (b) and (d) and under Article 13 of the Convention:

( i ) that the authorities failed to ensure the presence at the trial of attesting witnesses G.P.G. and A.V.K. who observed the Security Service officers mark and hand over to the victim the money to be used in the undercover operation designed to catch the applicant in the process of receiving the bribe and

(ii) that the authorities failed to disclose to the defence the court decisions authorising covert surveillance of the applicant and the recording of his conversations.

QUESTIONS TO THE PARTIES

1. Did the applicant have a fair hearing in the determination of the criminal charges against him, in accordance with Article 6 § 1 of the Convention and in the light in particular of the procedural guarantees afforded by:

1.1. Article 6 § 3 (b) of the Convention on account of the failure to disclose the court decisions to the defence ;

1.2. Article 6 § 3 (d) of the Convention on account of failure to ensure the presence at the trial of witnesses G.P.G. and A.V.K.?
