THIRD SECTION
Application no. 60830/19 Andrey Vitalyevich BARANOV against Russia lodged on 31 October 2019
SUBJECT MATTER OF THE CASE
The application concerns a restriction on the applicant ’ s right to leave Russia on account of his past awareness of State secrets. It is a follow-up case to the leading judgment of Berkovich and Others v. Russia ( nos. 5871/07 and 9 others, 27 March 2018), in which the Court found a violation of Article 2 § 2 of Protocol No. 4, noting the Russian authorities ’ failure to implement their accession commitment relating to the lifting of the travel ban on individuals aware of State secrets. The applicant had served in the Federal Security Service from 1996 until 2007 when he was made redundant. His former employer retained his travel document and restricted his right to leave Russia until 2021 on the grounds that he had taken cognisance of certain confidential information in 2016. His application for a judicial review was unsuccessful (final decision: Supreme Court, 30 August 2019).
QUESTION TO THE PARTIES
Has there been a violation of Article 2 of Protocol No. 4 on account of the restriction of the applicant ’ s right to leave Russia until 2021 (see Berkovich and Others v. Russia , nos. 5871/07 and 9 others, 27 March 2018)?
