Application no. 63202/19 Ruslan Vladimirovich KRAYUSHKIN against Russia lodged on 25 November 2019

SUBJECT MATTER OF THE CASE

The application concerns an allegedly negligible amount of award for a wrongful deprivation of liberty. The applicant had spent more than 130 days in detention. That period was later recognised to have been unlawful. He was awarded RUB 10,000 in respect of non-pecuniary damage, that is to say, an equivalent of approximately one euro per day.

QUESTION TO THE PARTIES

Was the sum awarded as damages to the applicant for his wrongful imprisonment so low as to undermine the essence of his enforceable right to compensation under Article 5 § 5 of the Convention (see Vasilevskiy and Bogdanov v. Russia , nos. 52241/14 and 74222/14 , §§ 23-26, 10 July 2018)?
