Application no. 30009/15 Marko STAMENKOVIĆ against Serbia lodged on 13 June 2015

SUBJECT MATTER OF THE CASE

The applicant was fined in minor-offences proceedings for disturbing public order and, subsequently, sentenced to one year ’ s imprisonment in criminal proceedings for causing grievous bodily harm . Both procedures concerned the same incident of 24 May 2008 when the applicant physically attacked M.V. The applicant appealed to the Constitutional Court about his two convictions, but the court rejected his case on 16 December 2014.

QUESTION TO THE PARTIES

Has the applicant been punished twice for the same offence in the territory of the respondent State, as prohibited by Article 4 § 1 of Protocol No. 7 (see Milenkovi ć v. Serbia , no. 50124/13, 1 March 2016)?
