SUBJECT MATTER OF THE CASE

The application concerns the dismissal of the appeal on points of law lodged by the Public Prosecutor in proceedings in which the applicant was a civil party. The applicant complains that the dismissal of the appeal as having been lodged out-of-time was formalistic because the time-limit should have been calculated from the day the decision appealed against was registered in the special registration book and not from the day it was pronounced.

QUESTION TO THE PARTIES

Has there been a violation of the applicant ’ s right of access to a court due to the rejection of the appeal on points of law lodged by the Public Prosecutor, based on the fact that it was lodged within thirty days of its registration to the special book rather than within thirty days of its pronouncement (see Aepi S.A. v. Greece , no. 48679/99, 11 April 2002)?
