SUBJECT MATTER OF THE CASE
The applicant stood as a candidate from the “ Batkivshchyna ” opposition party in the parliamentary elections of 28 October 2012 in single-seat constituency no. 11. She arrived the second having lost the elections to a self-nominated candidate. Her application raises allegations of serious irregularities in the tabulation process (including tampering with a large number of ballots initially counted in her favour during their storage in t he constituency election commission and a subsequent recount without due safeguards against abuse) which distorted the true opinion of voters and thus infringed her right to stand as a candidate in free elections.
QUESTION TO THE PARTIES
Has there been a breach of the applicant ’ s right under Article 3 of Protocol No. 1 to the Convention to free elections which ensure the free expression of the opinion of the people in the choice of legislature ?
