Application no. 40662/16 Karen MKRTCHYAN against Armenia lodged on 8 July 2016

SUBJECT MATTER OF THE CASE

The application concerns the quashing of a final judgment given by Kentron and Nork- Marash District Court of Yerevan on 20 February 2015 upon an out-of-time appeal lodged by the applicant ’ s opponent.

The applicant complains under Article 6 § 1 of the Convention that the decision of the Civil Court of Appeal dated 9 October 2015, which set aside a final judgment in his favour, was in breach of the principle of legal certainty.

QUESTION TO THE PARTIES

Was the quashing of the final judgment of the Kentron and Nork- Marash District Court of Yerevan of 20 February 2015 by the Civil Court of Appeal compatible with the requirements of Article 6 § 1 of the Convention (see Karen Poghosyan v. Armenia, no. 62356/09, §§ 44 and 46, 31 March 2016)?
