Application no. 54546/16 Zlate JOVANOVSKI against North Macedonia and 12 other applications (see list appended)
SUBJECT MATTER OF THE CASE
All applications concern civil proceedings in which the applicants (all Macedonians/ citizens of the Republic of North Macedonia) were ordered to pay a standing charge to a private heating company for the apartments (that they own and/or live in), which were disconnected (or have never been connected) from the district heating system. The present applications are part of a larger group of similar cases registered with the Court, following the leading case Strezovski and Others [ v. North Macedonia , nos. 14460/16 and 7 others, 27 February 2020].
QUESTIONS TO THE PARTIES
Was the system in which the heating standing charge operated in the applicants ’ cases compatible with Article 1 of Protocol No. 1 of the Convention ? Did the way in which the domestic courts interpreted and applied the applicable rules impose an excessive individual burden on the applicants (see Strezovski and Others v. North Macedonia , nos. 14460/16 and 7 others, 27 February 2020 ) ?
