SUBJECT MATTER OF THE CASE
The application concerns the authorities ’ alleged failure to provide the applicant, who currently serves his life sentence in the Dnipro Prison no. 89 and suffers from various serious medical issues including HIV and hepatitis C, with adequate medical treatment. Allegedly, no effective remedy is available in that regard. The applicant complains mainly under Articles 3 and 13 of the Convention.
QUESTIONS TO THE PARTIES
1. Did the circumstances and manner of the treatment by the prison authorities of the applicant ’ s ailments amount to inhuman or degrading treatment in breach of Article 3 of the Convention (see Nevmerzhitsky v. Ukraine, no. 54825/00, §§ 103-05, ECHR 2005 II; Melnik v. Ukraine, no. 72286/01, §§ 104-06, 28 March 2006; and Logvinenko v. Ukraine, no. 13448/07, §§ 68-78, 14 October 2010)?
2. Did the applicant have at his disposal an effective domestic remedy for his complaint under Article 3 of the Convention, as required by Article 13 of the Convention (see Melnik , cited above, §§ 113-16, and Logvinenko , cited above, §§ 84-85)?
