SUBJECT MATTER OF THE CASE

The application concerns taking of a part of land owned by the applicants and transferring it into the ownership of the local authorities on the basis of the 2011 Roads Act without compensation. It also concerns the lack of access to court to challenge registration of ownership in the name of the local authorities in the land register on the basis of 2011 Roads Act.

QUESTIONS TO THE PARTIES

1. Was the transfer of ownership of a part of land owned by the applicants to the local authorities on the basis of the 2011 Roads Act, in violation of the applicants ’ right to the peaceful enjoyment of their possessions, guaranteed by Article 1 of Protocol No. 1 to the Convention?

2. Did the applicants have access to court to challenge registration of ownership in the name of the local authorities in the land register on the basis of 2011 Roads Act, as required by Article 6 § 1 of the Convention?
