Application no. 59775/19 Ivan VRKLJAN against Croatia lodged on 8 November 2019

SUBJECT MATTER OF THE CASE

In the framework of a redundancy programme of his employer, the applicant was dismissed from a company where he had been employed for over 20 years because he had not had war veteran status. He unsuccessfully instituted a labour dispute challenging the decision on his dismissal. He complains that he was discriminated against on the sole ground that he did not have war veteran status, whereas his years of service had not been taken into account in the proceedings.

QUESTIONS TO THE PARTIES

Has the applicant suffered discrimination on the ground of his lack of war veteran status, contrary to Article 1 of Protocol No. 12 of the Convention? In particular, has the applicant been subjected to a difference in treatment and, if so, did that difference in treatment pursue a legitimate aim and have an objective reasonable justification in the circumstances?
