Applications nos. 12627/14 and 21226/14 Yaroslav Nikolayevich YEVTUSHENKO against Russia and Dmitriy Alekseyevich ISAKOV against Russia lodged on 27 January 2014 and 26 February 2014 respectively

SUBJECT MATTER OF THE CASE

The applications concern administrative proceedings against the applicants. They were fined under Article 6.21 § 1 of the Code of Administrative Offences of Russia for the “promotion of homosexuality among minors” while holding their solo “pickets”. The applicants complain of breach of their right to freedom of expression and in particular about the legislative ban on the promotion of homosexuality among minors, which they also consider discriminatory.

QUESTIONS TO THE PARTIES

1. Did the applicants ’ conviction of an administrative offence for “promotion of homosexuality among minors” violate their right to freedom of expression, contrary to Article 10 of the Convention (see Bayev and Others v. Russia , nos. 67667/09 and 2 others, § 83, 20 June 2017 )?

2. Have the applicant s suffered discrimination in the enjoyment of their Convention rights, contrary to Article 14 of the Convention read in conjunction with Article 10 (see Bayev and Others , cited above, §§ 87-92) ?
