QUESTIONS TO THE PARTIES

1. Did the material conditions of the applicant ’ s detention from 30 November 2019 till 3 January 2020, amount to inhuman or degrading treatment, in breach of Article 3 of the Convention?

2. Did the material conditions of the applicant ’ s detention from 4 January 2020 onwards, amount to inhuman or degrading treatment, in breach of Article 3 of the Convention?

3. Has there been a violation of Articles 2 or 3 of the Convention as a result of the alleged failure by the Maltese authorities to take appropriate measures with a view to protecting the detained applicant, in the light of the Covid-19 pandemic and his health condition? In particular, what measures were put in place by the authorities in this respect?
