Application no. 77610/17 Veaceslav APOSTOL and Natalia APOSTOL against the Republic of Moldova lodged on 27 October 2017 communicated on 17 May 2021

SUBJECT MATTER OF THE CASE

The application concerns the applicants ’ ill-treatment by private individuals and the alleged failure of the investigating authorities to carry out an effective investigation into their complaint about that ill-treatment. The applicants ’ criminal complaint was not examined (they were told that the trial court dealing with the case against them was competent to deal with any complaints raised by them).

The applicants complain of a violation of Article 6 § 1 – access to a court and fairness of the proceedings. The case essentially raises an issue under Article 3 of the Convention – procedural obligation to investigate allegations of ill-treatment.

QUESTION TO THE PARTIES

Do the facts of the case disclose a violation of Article 3 of the Convention? In particular, did the authorities carry out an effective investigation into the applicants ’ complaint that they had been ill-treated by private individuals ( Dornean v. the Republic of Moldova , no. 27810/07 , 29 May 2018)?
