SUBJECT MATTER OF THE CASE

The application concerns the applicant ’ s placement in a clinical infectious diseases hospital for involuntary diagnostics on suspicion of Coronavirus infection. The placement was ordered by the Petrogradskiy District Court of St Petersburg on 17 February 2020 at the request of the St Petersburg chief sanitary doctor of 13 February 2020. The applicant stayed at the said hospital until 21 February 2020.

QUESTION TO THE PARTIES

Has the applicant ’ s involuntary hospitalisation in the period between 17 and 21 February 2020 been lawful within the meaning of Article 5 § 1 (e) of the Convention? In particular, what was the legal basis for the applicant ’ s involuntary hospitalisation? The parties are invited to submit to the Court references to the relevant provisions of the domestic law and judicial practice, where available.
