SUBJECT MATTER OF THE CASE

The application concerns non-enforcement of domestic decisions giving custody of the two minor children of a couple to their mother, the applicant, and requiring the father to return them to her. Following the couple ’ s separation, decision no. 87/2018 of the Amaliada one-member Court of First Instance was issued which granted custody of the two children to the applicant and parental responsibility to both parents while it ordered the children ’ s father to return them to the applicant. That decision was confirmed by decision no. 195/2020 of the Patras Court of Appeal. According to the applicant, the father refused to comply with the above-mentioned decisions and the authorities were not sufficiently active to help her restore her relationship with his children, despite her relevant requests, including recourse to criminal proceedings against the father of the children.

QUESTION TO THE PARTIES

Has there been a violation of the applicant ’ s right to respect for her family life, as guaranteed by Article 8 of the Convention?

In particular, have the domestic authorities provided sufficient assistance to the applicant for the enforcement of the domestic decision granting her custody of the children and ordering the children ’ s return to her (decision no. 87/2018 of the Amaliada one-member Court of First-Instance as confirmed by decision no. 195/2020 of the Patras Court of Appeal)?
