The Committee of Ministers, under the terms of Article 32 (art. 32) of

the Convention for the Protection of Human Rights and Fundamental

Freedoms (hereinafter referred to as "the Convention"),

Having regard to the report drawn up by the European Commission of

Human Rights in accordance with Article 31 (art. 31) of the Convention

relating to the application lodged by Mr Guy Jespers against Belgium

(No. 8403/78);

Whereas on 4 March 1982 the Commission transmitted the said report to

the Committee of Ministers and whereas the period of three months

provided for in Article 32, paragraph 1 (art. 32-1), of the Convention

has elapsed without the case having been brought before the European

Court of Human Rights, in pursuance of Article 48 (art. 48) of the

Convention;

Whereas in this application, introduced on 23 October 1978, the

applicant presented a certain number of complaints concerning the

proceedings as a result of which he had been convicted, invoking

Article 5, paragraph 1 (art. 5-1), Article 6, paragraphs 1, 2, 3.b

and d (art. 6-1, art. 6-2, art. 6-3-b, art. 6-3-d), as well as

Articles 14 and 13 (art. 13, art. 14) of the Convention;

Whereas the Commission, after declaring the application partly

admissible on 15 October 1980, expressed in its report, by 9 votes

and 3 abstentions, the opinion that Article 6, paragraph 3.b

(art. 6-3-b), of the Convention had not ben violated and also that

Article 6, paragraph 1 (art. 6-1), had not been violated;

Agreeing with the opinion expressed by the Commission in accordance

with Article 31, paragraph 1 (art. 31-1), of the Convention;

Voting in accordance with the provisions of Article 32, paragraph 1

(art. 32-1), of the Convention,

Decides that, in this case, there was no violation of the Convention

for the Protection of Human Rights and Fundamental Freedoms.
