Length of proceedings before the Audit Court (Italy): violation

The case concerns the length of proceedings before the Audit Court. The proceedings began in June 1971 and were still pending at first instance in October 1999. They had theref ore lasted over 28 years and 3 months, including 26 years and 2 months after the entry into force of Italy’s acceptance of the right of individual petition.

Conclusion : violation (unanimous).

Article 41 - The Court awarded the applicant 30 million lire (IT L) in respect of non-pecuniary damage and 5 million lire in respect of costs and expenses.
