Length of pre-trial detention

Length of detention on remand: non-exhaustion

The case concerns the length of detention on remand. The Court noted that while the applicant had on three occasions appealed to the Court of Cassation against decisions of the Indictments C hamber rejecting his requests to be released, the appeals had been rejected on the ground that the applicant had not lodged pleadings in support of the appeals. The Court  therefore concluded that the applicant had not exhausted domestic remedies (see the Civet v. France judgment of 28 September 1999). It therefore upheld the Government’s preliminary objection.
