Application no. 48419/15 Bogdan Sorin ARHIRE against Romania

The European Court of Human Rights (Fourth Section), sitting on 21 October 2021 as a Committee composed of:

Armen Harutyunyan, President, Jolien Schukking, Ana Maria Guerra Martins, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 23 December 2015,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Bogdan Sorin Arhire, was born in 1983.

The applicant’s complaint under Article 3 of the Convention concerning inadequate conditions of detention in the Miercurea Ciuc Prison since 3 February 2011 was communicated to the Romanian Government.

THE LAW

Complaint under Article 3 of the Convention (inadequate conditions of detention)

Having examined all the material before it, the Court considers that for the reasons stated below, the application is inadmissible.

In particular, the Court notes that the present application is substantially the same as the matter already examined by the Court in the applicant’s case no. 14094/15 (see Arhire and Others v. Romania (dec.) [Committee], nos. 14094/15 and 16 others, 23 September 2021).

In view of the above, the Court finds that this application is inadmissible and must be rejected in accordance with Article 35 §§ 2 (b) and 4 of the Convention.

For these reasons, the Court, unanimously,

Declares the application inadmissible.
