DECISION

Application no. 50316/10 Guido Arturo ROSSI against Italy and 6 other applications

The European Court of Human Rights (First Section), sitting on 5 May 2022 as a Committee composed of:

Alena Poláčková, President, Raffaele Sabato, Davor Derenčinović, judges, and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above applications lodged on 27 August 2010,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix.

The applicants were represented by Ms Roberta Palotti , a lawyer practising in Milan.

The applicants’ complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 to the Convention concerning the retrospective application of Law 296/2006 to pending national proceedings commenced by the applicants were communicated to the Italian Government (“the Government”).

On 19 November 2018 the Government informed the Registry that the applicants had died. On 3 April 2019 the applicants’ representative replied to the letter of the Government that “research on the applicants was in progress”. The applicants’ representative did not provide any subsequent information, nor did she specify that the applications to the Court would be pursued by any heir.

THE LAW

Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

In the light of the foregoing, the Court concludes that there is no indication that following the applicants’ death any heir wishes to pursue the applications within the meaning of Article 37 § 1 (a) of the Convention. It further finds no reasons to justify the continued examination of the applications.

Accordingly, the cases should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to join the applications;

Decides to strike the applications out of its list of cases.
