FIRST SECTION

DECISION

Application no. 42457/19 Jacek GAJOWCZYK against Poland

The European Court of Human Rights (First Section), sitting on 19 May 2022 as a Committee composed of:

Alena Poláčková, President, Raffaele Sabato, Davor Derenčinović, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 30 July 2019,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Jacek Gajowczyk, was born in 1969.

The applicant’s complaints under Article 6 § 1 and Article 13 of the Convention concerning the excessive length of criminal proceedings and the lack of any effective remedy in domestic law were communicated to the Polish Government (“the Government”).

On 29 September 2021 the applicant’s representative informed the Registry that applicant had died and that his application with the Court would not be pursued.

THE LAW

In the light of the foregoing, the Court concludes that the applicant’s heirs, if any, do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 9 June 2022.

Viktoriya Maradudina Alena Poláčková Acting Deputy Registrar President
