FOURTH SECTION
DECISION
Application no. 72458/17 ASSOCIATED NEWSPAPERS LIMITED
against the United Kingdom
The European Court of Human Rights (Fourth Section), sitting on 22 September 2022 as a Committee composed of:
Armen Harutyunyan , President,
Jolien Schukking ,
Ana Maria Guerra Martins , judges,
and Viktoriya Maradudina, Acting Deputy Section Registrar,
Having regard to the above application lodged on 29 September 2017,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Associated Newspapers Limited, was established in 1905.
The applicant was represented by Mr K. Mathieson, a lawyer practising in London with RPC LLP.
The applicant’s complaints under Article 10 of the Convention, concerning its liability to pay the success fees and after-the-event insurance premium of a claimant who issued libel proceedings against it, were communicated to the United Kingdom Government (“the Government”) on 28 April 2022.
On 22 July 2022 the applicant informed the Registry that it wanted to withdraw the application to the Court as the parties had reached a settlement.
THE LAW
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 13 October 2022.
