DECISION

Application no . 36507/05 Gligor TEMKOV against the former Yugoslav Republic of Macedonia

The European Court of Human Rights (First Section), sitting on 18 June 2013 as a Committee composed of:

Elisabeth Steiner, President , Linos-Alexandre Sicilianos, Ksenija Turković, judges , and André Wampach , Deputy Section Registrar ,

Having regard to the above application lodged on 20 September 2005,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Gligor Temkov, was a Macedonian national, who lived in Strumica. He was represented before the Court by Mr N. Tošev, a lawyer practising in Strumica.

The Macedonian Government (“the Government”) were represented by their Agent, Mr K. Bogdanov.

The applicant complained under Article 6 § 1 about few sets of civil and administrative proceedings. The complaint about the length of the proceedings had been communicated to the Government.

By a letter of 10 August 2012 his representative informed the Court that the applicant had died and that “his daughter is not interested for the case and avoids any contacts with him”. No heirs expressed the wish to pursue the application.

THE LAW

In these circumstances, in the absence of any heir expressing the will to take over and continue the application, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case within the meaning of Article 37 § 1 in fine of the Convention.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court unanimously

Decides to strike the application out of its list of cases.
