DECISION

Application no . 54044/09 Eduard Vitalyevich SHUKSHIN against Russia

The European Court of Human Rights ( First Section ), sitting on 26 November 2013 as a Committee composed of:

Khanlar Hajiyev, President, Julia Laffranque, Erik Møse, judges, and André Wampach , Deputy Section Registrar ,

Having regard to the above application lodged on 16 September 2009 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1. The applicant, Mr Eduard Vitalyevich Shukshin , is a Russian national, who had been born in 1978 and lived in Perm .

2. The Russian Government (“the Government”) were represented by Mr G. Matyushkin , the Representative of the Russian Federation at the European Court of Human Rights .

3. The applicant complained under Article 3 of the Convention about the conditions of his detention in a penitentiary colony in the Perm Region of Russia .

4. By letter of 23 May 2013, the Government informed the Registry that the applicant had died in detention on 31 July 2010 .

THE LAW

5. The Court notes that the applicant has deceased and no heirs or next ‑ of-kin have expressed the wish to pursue the complaint. In these circumstances t he Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court considers that there are no particular circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court unanimously

Decides to strike the application out of its list of cases.
