DECISION
Application no . 13420/06 DIONYSOS MERENI and O thers against the Republic of Moldova
The European Court of Human Rights ( Third Section ), sitting on 3 December 2013 as a Committee composed of:
Luis López Guerra, President, Nona Tsotsoria, Valeriu Griţco, judges, and Marialena Tsirli , Deputy Section Registrar ,
Having regard to the above application lodged on 4 April 2006 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
A list of the applicants is set out in the appendix. They are represented by D. Ciobanu, the administrator of the first applicant.
The Moldovan Government (“the Government”) were represented by their Agent, Mr L. Apostol.
The applicants complained under Article 1 of Protocol No. 1 to the Convention about the allegedly arbitrary deprivation of their property . In particular, they argued that the annulment of a sales contract between the applicant company and the other nineteen applicants had not been lawful.
On 11 December 2008 the Court decided to communicate the application to the Government .
On 13 September 2013 the applicants ’ representative informed the Court that the applicants wanted to withdraw the application since the proceedings in their case had been extraordinarily reopened, following which their property right and the validity of the contract had been confirmed .
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court unanimously
Decides to strike the application out of its list of cases.
