Application no . 71858/11 Uros SUBOŠIĆ and others against Bosnia and Herzegovina and 50 other applications (see list appended)

The European Court of Human Rights ( Fourth Section ), sitting on 17 December 2013 as a Committee composed of:

George Nicolaou, President, Zdravka Kalaydjieva, Faris Vehabović , judges, and Fatoş Aracı , Deputy Section Registrar ,

Having regard to the above applications lodged between 19 October 2011 and 9 April 2013 ,

Having regard to the formal declarations accepting a friendly settlement of the cases,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

A list of the applicants is set out in the appendix.

The Government of Bosnia and Herzegovina (“the Government”) were represented by their Agent, M s M. Mijić .

The applicants complained under various Article s of the Convention of the non-enforcement of final domestic judgements rendered in their favour against the Republika Srpska for war damage.

Between 8 May 2013 and 21 October 2013 the Court received friendly settlement declarations signed by the parties under which the applicants agreed to waive any further claims against Bosnia and Herzegovina in respect of the facts giving rise to these applications against an undertaking by the Government to pay them ex gratia 1,000 euros to cover any non-pecuniary damage as well as costs and expenses, which will be converted into convertible marks at the rate applicable on the date of payment, and would be free of any taxes that may be applicable . It will be payable within three months from the date of notification of the decision taken by the Court. In the event of failure to pay these sum s within the said three-month period, the Government undertook to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default perio d plus three percentage points.

The parties, furthermore, agreed that the Government would secure full enforcement of the domestic judgements under consideration in the cases nos. 71858/11 and 5758/12 [1] in cash in four equal instalments which would be paid in the following manner:

- the first instalment within nine months from the date of the notification of the decision taken by the Court;

- the second instalment within six months from the first payment;

- the third instalment within six months from the second payment; and

- the fourth instalment within six months from the third payment.

As regards the remaining 49 cases, the parties agreed that the Government would secure full enforcement of the domestic judgements under consideration in those cases in cash within nine months from the date of the notification of the decision taken by the Court. [2]

The se payment s will constitute the final resolution of the case.

THE LAW

The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications. In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court unanimously

Decides to join the applications;

Decides to strike the applications out of its list of cases in accordance with Article 39 of the Convention.
